PROMOTIONAL LEGAL BASES OF THE PROMOTION

IGUANA SMOKE THIRD ANNIVERSARY - WIN A TRIP TO AMSTERDAM

 

The company LYFHEMP SL (".LYF") with registered office at Calle Santa Virgilia 16, Bajo derecha A in Madrid and tax identification number B05292933, is the organiser of the present promotion (hereinafter referred to as the "Promotion").

The Promotion will be announced on Iguana Smoke's social networks and will be hosted on the website www.iguanasmoke.com/concurso-amsterdam-iguana-smoke/.

Only those persons who accept the following conditions are eligible to participate in the Promotion conditions of participation (hereinafter referred to as "Basis"). Participation in the Promotion therefore implies acceptance of the Rules.

Each person participating in the Promotion is a "Participant" for the purposes of the Rules.

FIRST.-Legitimacy to participate Only natural persons over eighteen years of age, resident in Spain, may participate in this Promotion voluntarily and free of charge.

Persons who have a direct or indirect relationship with LYF are not eligible to participate in the Promotion, therefore excluding their employees and those of their controlled or affiliated companies.

LYF intends the Promotion to be conducted in good faith and therefore reserves the right to automatically and immediately exclude from the Promotion any Participant who violates the rules of good faith, behaves inappropriately, uses fraudulent means or breaches these Rules in any way.

SECOND - Territory This Promotion will be in force in Spain.

THIRD - Term. The Promotion will start at 10:00 a.m. on 22 November 2024 and will end at 23:59 p.m. on 15 December 2024. Thereafter, persons who have subscribed beyond 15 December 2024 at 23:59 hours will not be counted for the purposes of their participation in the Promotion.

FOURTH: Form of participation  . The Promotion will be hosted on the Landing Page [www.iguanasmoke.com/concurso-amsterdam-iguana-smoke/] (hereinafter referred to as the "Landing") and access to the Landing Page will be essential in order to participate in the Promotion. From the first day of the Promotion until the last day inclusive, Participants may participate in the Promotion by following the procedure below via the Landing Page:

• Duly complete the form, correctly recording the required information in accordance with the form and these Rules.
• Accept these Terms and Conditions.
• Accept the Privacy Policy.
• Follow Iguana Smoke on Instagram @iguanasmoke.com
• Comment and share the contest post shared on Iguana Smoke's Instagram @iguanasmoke
• Subscribe to the Iguana Smoke newsletter at iguanasmoke.com

Once all these requirements have been met, the person will be considered a Participant in the Promotion.

Participants will only be required to register 1 (one) time. Successful registration for any Promotion will entitle each Participant to participate in the relevant Promotion and in turn to participate in subsequent Promotions pending activation on the date of registration, but not in previous Promotions.

FIFTH. Selection of the winning person. Among all the Participants who have successfully completed the previous process there will be one (1)

The winner will be selected through a draw among all participants using the esypromos application.

The name of the winner will be communicated by email on 20 December 2024 and published on iguana Smoke's networks.

In the event that no response is received within 24 hours of the initial communication, LYF may proceed to contact new winners who will be chosen by the same procedure as above.

From the moment the winners are notified, they undertake, by the mere fact of being winners, to follow all the instructions given to them by LYF at all times (both before and during the celebration of the Prize).

By accepting these Rules, the winner confirms that he/she is aware of the conditions of participation in these Rules and guarantees that he/she and his/her companion, if any, are over eighteen years of age.

SIXTH - Prize.- The Prize consists of a trip to Amsterdam, the Netherlands, for two people and includes flights from Spain to Amsterdam with the possibility of departure from Madrid or Barcelona, and two (2) nights in a three-star hotel in a room for two people including breakfast. The total cost of the trip will never exceed €700 between flights and hotels. The winner must agree with LYF the date of the trip, which must be between January and March 2025. Within this period, the winner may select the date by mutual agreement with LYF on which to redeem the prize, subject to the conditions of the company organising the prize. If the winner does not redeem the Prize within the time period set out above, he/she may be subject to not being able to celebrate the Prize and LYF shall not be liable for this.

The Prize will not include travel or subsistence expenses that are not explicitly detailed in these Terms and Conditions or in the Promotion in general, nor any other expenses arising from the receipt and materialisation of the Prize by the winners and/or their companions that are not expressly mentioned in these Terms and Conditions.

LYF shall have no liability whatsoever in the event that the Prize cannot be fulfilled for reasons beyond its control.

The Prize is not redeemable for cash value or any other prize.

LYF expressly reserves the right to modify the Prize indicated by another of equal value, as well as the date of the same for justified reasons.

Any liability, other than the Prize assumed by LYF in this clause, arising from the enjoyment of the Prize shall be borne solely by the winner. LYF shall not be liable for any loss, damage and/or impairment incurred by the winner and/or his/her companion as a result of the materialisation and/or enjoyment of the Prize.

SEVENTH.- Changes in the Promotion: LYF reserves the right to make any changes to the terms and conditions of the Promotion, as well as to suspend or extend the Promotion at any time it deems appropriate for justified reasons. Likewise, LYF reserves the right to interrupt access to or continuity of the Promotion at any time, either temporarily or permanently, for reasons of security, restructuring or interruption of computer services, or any other cause that so advises or that is not the responsibility of LYF, without any liability for LYF or right to compensation.

EIGHTH: Participation in this Promotion implies:

1. The full acceptance of these Rules.
2. Full acceptance of the Privacy Policy of the organiser of this Promotion.
3. The express waiver of any other jurisdiction that may correspond to them, accepting the Courts and Tribunals of the city of Madrid as the competent jurisdiction for the resolution of any claim.

NINTH. Disclaimer of liability  LYF shall have no liability whatsoever in the event that the Promotion cannot be carried out as planned for reasons beyond LYF's control (e.g. viruses, bugs or computer errors, unauthorised interventions, fraud, technical failures, human error or any other circumstances beyond LYF's reasonable control, which may disrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion).

Furthermore, LYF reserves the right to cancel the Promotion or to disqualify any Participant who has attempted to manipulate, cancel, terminate, modify or suspend the Promotion, and/or cancel the receipt of participation requests; as well as to expel any Participant, even after having been declared the winner, and if applicable refuse to award him/her the Prize, is suspected of wanting to break the law, generate violent or pornographic acts and in general of any conduct or act contrary to the law and/or good customs. 

LYF shall not be liable for any technical problems or failures in telephone networks and lines, on-line systems, servers or suppliers, computer equipment, software, failures in the reception of e-mails due to technical problems or congestion in the Internet network or web pages, etc., and, in general, for any damage or harm to the Participant arising from participation in the Promotion or the unavailability of the same due to problems of a technical nature not attributable to LYF, as well as in the case of difficulties in the subscription process, such as technical problems, connectivity problems, etc.

Finally, LYF shall not be liable for the combination of any of these circumstances,

including damage to a Participant's or any other person's computer system or in any way arising out of the Promotion and its promotion or advertising.

TENTH - Data protection. The personal data of the natural persons participating in the Promotion will be processed in accordance with the Privacy Policy indicated in clause eight.
